Experiencia:


Telecommunications

  • Legal advice and participation in the public bidding procedure for the occupation and exploitation of the 77º geostationary orbital position, for a consideration of more than 130 million pesos.
  • Legal advice on the installation and operation of a telemetry, tracking and command center for the operation of a Mexican satellite system.
  • Legal advice and representation before the Ministry of Communications and Transportation and/or the Federal Telecommunications Institute (IFT) for the application and granting of several concessions and authorizations to provide telecommunications and broadcasting services.
  • Verification of compliance with regulatory obligations and representation in sanction proceedings initiated by the regulatory body. Advice in case of inspection and audit visits.
  • Negotiation and drafting of interconnection agreements and specialized telecommunications agreements. Representation in proceedings derived from interconnection disputes.
  • Design of a legal strategy for the development of a public-private partnership project in the telecommunications sector.

Economic Competition

  • Legal advice to a telecommunications company regarding the filing of the notice of merger before the IFT in accordance with the ninth transitory article of the Constitutional Reform, and representation before the IFT during the investigation to determine the agent with substantial power in the relevant market.
  • Advice and representation during investigations by the Federal Economic Competition Commission (COFECE) or the IFT for the possible commission of absolute or relative monopolistic practices, either as a defendant, complainant or third party.
  • Advice and representation in the filing of a complaint for relative monopolistic practices against PEMEX, which resulted in the implementation of certain measures by such entity.
  • Development and implementation of a compliance program for a pharmaceutical company in order to identify and elaborate strategies for risk management in economic competition matters.

Administrative

  • Legal advice and representation before the Federal Consumer Protection Agency (Procuraduria Federal del Consumidor) for contract registration and verification procedures.
  • Legal advice for the handling of personal data and actions aimed at data protection and compliance with obligations.
  • Advice for the regularization of the concession for the occupation of the federal maritime-terrestrial zone (submarine cable laying) before the SCT.
  • Representation before the Ministry of Defense (Secretaría de Defensa Nacional) for the commercialization of weapons and implementation of the recall program related to firearms.
