David Guillén Llarena has more than 34 years of professional experience, particularly in the fields of Telecommunications, Infrastructure, Litigation, Arbitration and Dispute Resolution. He has been a founding partner since March 1990, when he joined the firm Ríos Ferrer, Guillén-Llarena, Treviño y Rivera, S.C..

Academic Background

Mr. Guillén has represented several assignees and concessionaires before administrative authorities in administrative proceedings related to the granting of telecommunications and broadcasting concessions, as well as the enforcement of partial assignment of rights agreements in port matters.

Also, Mr. David Guillén is an expert in the areas of Litigation, Administrative, Commercial and Civil Law, as well as Telecommunications, Infrastructure, Constitutional Law, Port Law and Arbitration, both nationally and internationally.

He also has experience in alternative dispute resolution procedures, ranging from formal, institutional and ad hoc arbitration proceedings to mediation and conciliation procedures. Mr. Guillén has extensive experience in litigation related to contract compliance, civil liability, foreclosure, monopolies, antidumping, insurance, banking, property, among others.

Mr. David Guillén provided advisory services to the Ministry of Communications and Transportation (“SCT”) in the resolution of complex administrative and judicial disputes, he was responsible for the substantiation of 275 relevant lawsuits in defense of the SCT's interests, which have been handled through an innovative legal consulting contracting model that proved to be effective and efficient, having achieved a high percentage of success and substantial savings for the SCT in the attention and follow-up of more than 1,300 lawsuits.

In port matters, he has advised companies that assign port rights and integral port administrators, both in the implementation of new assignment schemes and in the drawing up of contracts for the construction, operation and management of terminals. Likewise, Mr. David Guillén has represented several assignees and concessionaires before administrative authorities in administrative proceedings and procedures related to the granting of concessions and compliance with partial assignment of rights agreements. Specifically, he provided legal advisory and consulting services to the Port Authority of Manzanillo, in connection with the public bidding process and award of the Specialized Container Terminal II of the Port of Manzanillo.

In addition, Mr. Guillén Llarena has provided legal advice to several telecommunications companies regarding the obtaining of permits and concession agreements, he has also participated in bids related to the radio electric spectrum, he has also participated in the negotiation of several interconnection agreements, and he has been an external advisor to the Federal Telecommunications Institute for the supervision and verification of the Preponderant Economic Agent in the broadcasting sector.

He has participated in the structuring of different tourism and property/real estate projects, especially in the structuring of the timeshare system in Mexico, in which he participated in the drafting of the Federal Regulations and in the draft Law of the State of Guerrero. Some of the projects in which he has participated include public and private co-investments in tourism in various tourism developments in Huatulco, Oaxaca; Cancún, Quintana Roo; Ensenada, Baja California; and Los Cabos, Baja California Sur.

(2013) Legal advice for the defense of the rights of the Asociación Nacional de la Industria de la Seguridad Privada, A.C., due to the denial of authorization by the Ministry of Economy to create a chamber of the specific industry with national circumscription regarding the private security activity, through an administrative litigation procedure.

(2012) Legal advice for the preparation and filing of an amparo action filed by Consorcio Intercom, S.A. de C.V. and The Pasha Group, S.A. de C.V., against Administración Portuaria Integral de Lázaro Cárdenas, S.A. de C.V., regarding the Award of a Partial Assignment of Rights Agreement consisting of the construction of a public use terminal in such area, specialized in automobiles and rolling vehicles.
